General terms and conditions for private customers ("GTC Pk") from 01. January 2018

Subject and application of the "GTC Pk"

These General Terms and Conditions (hereafter referred to as GTC) govern the relationship between PEMA OF TIBET AG (as the operator of pema-of-tibet.ch) and the customer.

These terms and conditions are part of every contract between PEMA OF TIBET AG and the customer.

Prices

All prices include 7.7% VAT.

The prices in our offers and order confirmations are always binding. Significant errors are reserved.

Payment Switzerland

(see also delivery conditions)

You can pay online via postcard. We deliver against prepayment or on account.

In case of an invoice, we will send you a payment slip together with the delivery.

For the first order of private individuals, we send the invoice in advance (prepayment) by mail and once your payment has been received, we will send you the ordered goods.

Pay abroad

Orders abroad must always be paid in advance (prepayment).

You have two options:

You make a bank transfer to our bank account in Switzerland. The account information received

You immediately after the order by e-mail.

You send us the amount in cash in a registered letter.

You should also note that we send the goods from Switzerland and declare them correctly for customs. As a result, you will eventually receive an invoice from customs for your country's import VAT.

Expiration of the order

Individuals receive an invoice for the first order in order to pay in advance. Customer

from abroad receive payment information by e-mail. If no payment is received 10 days after billing / payment information, the order will be forfeited and the ordered quantities can no longer be guaranteed for a new order or late payment. PEMA OF TIBET AG reserves the right to refuse orders from customers who in the past have had orders expire in this way.

liability

PEMA OF TIBET AG disclaims any liability for damage or injury resulting from the improper or careless handling of the purchased goods. By purchasing the goods, you confirm that you use them only for their intended purpose.

Delivery, shipping costs

The shipping costs are up to 2 kg flat rate 9.50 francs for deliveries to Switzerland. Packages over 2 kg will be charged according to postal rate.

For deliveries abroad, the shipping costs are calculated based on weight.

The items are usually delivered within 72 hours after receipt of order or after receipt of payment (in advance). In no case shall delivery delays justify claims for damages or a right of withdrawal from the contract. Shipping is at the risk of the customer.

Minimum Order Quantity

The minimum order quantity is 20.00 francs (without shipping costs). For orders below 20.00 francs, a small quantity surcharge of 10.00 francs will be charged to cover the processing costs.

refund policy

The return of the ordered items is only possible in the case of a defect of the delivered goods. The potential damage due to use listed under "Warranty" (see below) is expressly not a reason for return. "Do not like" is not a return reason!

warranty

PEMA OF TIBET AG guarantees the functionality of the delivered goods for their intended purpose. The following irregularities occurring with handcrafted articles are expressly no cause for a notice of defect or a guarantee exchange:

- Natural color and texture nuances of the gemstones

- Traces of work processes on all handcrafted goods

- Normal oxidation of silver parts (can easily be polished away yourself according to the care instructions for silver jewelery)

data protection

The customer data is only used within PEMA OF TIBET AG and will not be passed on to third parties. The guidelines of the valid data protection legislation are respected.

jurisdiction

All obligations are subject to Swiss law. Place of fulfillment and exclusive place of jurisdiction is Rüfenach. Rüfenach, January 01, 2018
